is a process under the jurisdiction of the United States Bankruptcy Court, designed
to regulate and administer the payment and discharge of debts . Bankruptcies can
generally be described as "liquidations" or "reorganizations." Chapter
7 bankruptcy is the liquidation variety: If you own property that isn't
exempt under your Maryland laws, it may be taken and sold ("liquidated") to pay
back some of your debt. Chapter 13 bankruptcy is the most common type of "reorganization"
bankruptcy for consumers: You get to keep your property, but you must make monthly
payments over three to five years to repay all or some of your debts. The
Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 The
new law establishes the criteria for Chapter 7 filing. Most credit
card debts, medical bills and personal loans can be discharged in a typical
chapter 7 bankruptcy. A Chapter 13 bankruptcy case involves a three to five year
repayment plan. To qualify for Chapter 13, you must have a regular source of income,
have enough disposable income, and your debts must be under certain debt limits.
Richard J. Hackerman is an experienced foreclosure attorney having handled numerous
foreclosure cases. Richard J. Hackerman is a bankruptcy/foreclosure
attorney and can assist you. Both
Chapter 13 and Chapter 7 bankruptcies have numerous rules -- and exceptions to
those rules -- about what kinds of debts are covered, who can file, and what property
you can and cannot keep. The bankruptcy
process is initiated by the filing of the petition in the United States Bankruptcy
Court. The petition contains the Debtor's name and address, the type of
bankruptcy being filed and general information about the case. Along with
the petition schedules have to be filed outlining the Debtor's assets, debts,
income and expenses. A Statement of Affairs must also be filed setting forth
the Debtor's prior income, lawsuits and enforcement actions commenced against
the Debtor, business history and other financial related matters.
In a chapter 13 case a repayment plan must be prepared and filed setting
forth the Debtor's intentions with respect to payment of all or some of their
debts. These are just some of the documents that must be filed. I
will assist you in all phases of this process. The
Debtor along with their attorney must also attend a meeting of creditors where
the Debtor will be asked a series of questions, under oath, by a Trustee
appointed by the United Stated Bankruptcy Court regarding their financial affairs.
In a chapter 13 bankruptcy case,
the Debtor and their attorney are required to attend a confirmation hearing where
the plan that is filed outlining the Debtor's intentions with respect to
repayment of all or a portion of the individual's debts will be addressed by a
United States Bankruptcy Judge. I will assist you in all phases of this
process. With over twenty five

I treat clients with respect.
I will answer your questions and attempt to explain the bankruptcy process
to you that so that you understand your case.
Your property is, of course, a major concern when contemplating filing a bankruptcy.
Under either chapter, the Bankruptcy Code has provided a means by which to protect
your personal property and real estate. These protections are known as exemptions.
The
exemptions are relatively complicated to understand and you should discuss how
they apply to your property with me. In
Maryland property owned by married couples is exempt with respect to claims of
creditors of solely one spouse, (other than claims of the Internal Revenue Service) If
you are considering filing for bankruptcy, you should know about one major change
to the bankruptcy law: Beginning October 17, 2005, you must get credit counseling
from a government approved organization within six months before you file for
bankruptcy protection and receive pre-discharge education in order to complete
the case after you file. Every
person that finds themselves with unmanageable debt finds themselves in that
situation for a different reason. There is no single plan that works for
everyone. Richard Hackerman can help you figure out the best
path out of debt for your particular debt situation, and we can put you on that
path to debt freedom. Richard J. Hackerman, P.A. is a debt relief agency.
